Dealer Recall Survey
Dealers,
Congress is back from its summer recess and is expected to address a number of issues in the coming weeks, including highway funding and safety recall issues. Before adjourning in late July, the Senate passed its version of a highway bill that included a provision that would require rental car companies to ground all vehicles in their fleets subject to an unremedied safety recall. A proposed amendment to prohibit the sale, at retail or wholesale, by dealers of used vehicles subject to an unremedied recall did not make it into the Senate bill, but it is expected to be offered as an amendment to the House version. The White House, the Department of Transportation, NHTSA, consumer groups, and a number of prominent Democrats are all supporting the proposed dealer grounding amendment. In addition, some of the auto manufacturers are supporting the Senate rental car grounding provision, and FCA recently signed a consent decree with NHTSA in which it agreed to adopt a policy prohibiting FCA dealers from selling new or used vehicles subject to open safety recalls.
We believe that the proposed grounding amendment could cripple the used car market, leaving consumers with diminished trade-in values that will impact the sale of new vehicles. To inform our advocacy on this issue, NADA is conducting formal research to determine the consumer ramifications of a government mandated grounding of dealer-held used vehicle inventory with unremedied recalls. As part of this research, they have commissioned a brief dealer survey to help identify and measure the impact of the proposed recall amendment.
