Do
Demonstrators need to have a used car Buyers Guide
displayed?
Yes.
For purposes of the Federal Trade
Commission’s “Used Car Rule”, a demonstrator
has been “driven
more than the limited use necessary in
moving or road testing a new vehicle prior to
delivery to a consumer” and therefore requires a
Buyers Guide to be posted.
What
is the correct format for a Buyers Guide?
All
Buyers Guides must comply with strict,
standardized requirements.
The Rule requires the Buyers Guide be
printed in 100% black ink on white stock that is
at least 11 inches high and 7 ¼ inches wide.
When
offering a limited warranty, how should the Buyers
Guide be filled out?
Mark
the large box next to the word “warranty” and
complete the other parts of the warranty section
of the Buyers Guide.
Mark the box to indicate that the warranty
offered is “Limited”.
Next, fill in the percentage of the repair
cost that will be paid by the dealer.
Indicate which of the specific systems are
covered. Do
not use shorthand terms like “drive train” or
“power train”.
Instead, use the exact systems that are
covered, such as “frame and body”, “brake
systems”, etc.
Also, indicate the duration of the
warranty.
What
Dealer Identification information is required to
be on the Buyers Guide?
The
name and address of the dealership must be
included. AND,
the name and telephone number of the person to
contact for complaints must also be included.
The FTC has also suggested including the
position of the person, so that consumers will
know who to contact if that person has left the
dealership.
Must
a consumer sign the Buyers Guide?
No.
There is no signature requirement.
What
are the rules when conducting Spanish-language
sales?
If
a used car transaction is conducted in Spanish,
the Used Car Rule requires that the dealer display
a Spanish-language version of the Buyers Guide on
the vehicle prior to offering the vehicle for
sale. If
a dealership conducts a substantial number of
sales in Spanish and English, it should both
versions of the Buyers Guide in the side window(s)
of the vehicle.
May
the Buyers Guide be removed for a test drive?
Yes,
but it must be returned to the window as soon as
the test drive is over.
