Shine a Light on Compliance with Internal Paperwork Audits

Dealership compliance with federal and state laws is once again coming under the increased scrutiny of state and federal regulators. Since May of 2020, at least sixteen state Attorneys General have sued dealerships or issued statements alleging that dealership are engaging in predatory and harmful practices. The Federal Trade Commission (FTC) has also made it clear that it is tracking dealership compliance. This past May, the FTC entered into a $1.5 million consent order with Bronx Honda; in July, it released two staff reports criticizing several common dealership practices; and as recently as this month, the FTC boasted about how one of its enforcement actions helped put a group of auto dealerships out of business.

These enforcement activities and the increasing number of consumer complaints make it clear that dealers should make reviewing paperwork and related policies and procedures a priority.
