Attention HR Managers! New Updates to Federally Mandated Posters

There have been some updates to two federally mandated posters, which employers are required to display in a location where employees can readily see it. These include changes to:

The Fair Labor Standards Act Notice (Federal Minimum Wage Poster)

Changes to this notice include new provisions for nursing mothers:  The FLSA requires employers to Federal Minimum Wage Poster Illustrationprovide reasonable break time for a nursing mother employee who is subject to the FLSA's overtime requirement in order for the employee to express breast milk for her nursing child for one year after the child's birth each time such employee has a need to express breast milk. Employers are also required to provide a place, other than a bathroom, that is shielded from view and free from intrusion from coworkers and the public, which may be used by the employee to express breast milk.

Other changes include a beefed up enforcement section (this section has been significantly revised), and new language that addresses the misclassification of workers as "independent contractors." The revised notice can be found HERE, as well as on our website, www.oada.com.

Most of the changes to this required notice are cosmetic, and include a QR Code at the bottom. However, as
