Understanding the Ohio Notary Modernization Act

The Ohio Notary Modernization Act overhauls Ohio's notary laws by centralizing the application process to ensure consistent standards across the state. Under the new law, the Ohio Secretary of State's office will be charged with processing and managing the notary application and renewal process in Ohio. Additionally, the law places a stronger emphasis on educating notaries throughout their tenure to ensure that all notaries remain aware of their obligations. Finally, recognizing that transactions are moving off paper and to a digital format, the new law creates the ground work for permitting electronic and online notarial acts.

In addition to the new statute, which mostly goes into effect on September 20, 2019, the Ohio Secretary of State's Office is working on administrative rules to assist in clarifying these changes. Particularly with authorized education programs, technology standards, investigation and discipline procedures, and modified forms for notarial seals and certificates.
