As one of the most regulated industries, dealerships are no strangers to compliance concerns. And 2018 proved to be a year of wake-up calls for dealers to remain vigilant about compliance. In one short year, a dealership settled a federal class-action suit under the Telephone Consumer Protection Act ("TCPA") for almost $4.8 million. The Department of Justice reached an agreement with a dealership group to settle claims of bank fraud. Two people, including the dealer principal, received jail time and the dealership agreed to restitution. The FTC took aim at a dealership group for allegedly falsifying consumers' income and down payment information on credit applications and misrepresenting financial terms in advertisements. It also continued its trend of keeping an eye on safety recall issues - announcing a settlement with a dealer group and its president and vice president for advertising campaigns that featured an "urgent recall notice."

And Ohio dealers have certainly seen their share of regulatory activity. The FTC, the Cuyahoga County Department of Consumer Affairs, and the Ohio Bureau of Motor Vehicles worked together and walked dealership lots in the Cleveland area to determine if dealerships were correctly displaying the revised Buyers Guide. The Ohio Attorney General has also pursued dealers for titling issues and privately reached out to car dealers regarding alleged advertising violations.
