OADA Webinar

Similar to romantic relationships, employment relationships rarely have a “happily-ever-after” and a breakup is inevitable.  Whether the employment relationship is terminated voluntarily by the employee or involuntarily by the employer, preparation and documentation will make for a smoother transition for all involved.

OADA is pleased to welcome Maribeth Wuertz from Fisher Phillips, for a webinar to discuss employment termination procedures and documentation, and to provide answers to your most pressing questions!

This webinar will cover the nuts and bolts of carrying out an employment termination, including:

(1)  Termination Preparation

  • Review decision and support for decision, including relevant handbook policies, prior warnings
  • Approval of decision by upper management/HR
  • Identify red flags, i.e., employee is or was on a medical leave, filed a worker's comp claim, is an older worker, complained about discrimination or harassment or other legal claims.
  • Consider consultation with employment law counsel

(2)  Termination Documentation. What kind of documentation should be prepared and where should it be maintained.

  • Investigation notes and witness interviews
  • Determination - conclusion of investigation and determination to terminate employment
  • Termination notice
  • Final paycheck, including vacation/PTO and appropriate deductions
  • Letter to employee regarding termination
  • Severance Agreements

(3)  Conducting the Termination Interview

  • Who should attend
  • Notes of interview
  • What to say and not to say
  • Addressing hostile/emotional reactions
  • Offering a severance agreement

(4)  Post-Termination Considerations

  • Responding to claims for unemployment compensation
  • Requests for references
  • What to say to co-workers
  • Non-compete/solicitation agreements
